Delhi woman gets paid Rs. 2 crore compensation from ITC Maurya!

A compensation of Rs. 2 crores is awarded to a woman by the National Consumer Disputes Redressal Commission. The compensation was given to the woman for a long haircut and a treatment by a staff given to her at a salon which is located in hotel ITC Maurya in 2018 which has resulted in her little or almost no hair. The complainant was actually a model for hair products. This order was then passed by Dr. SM kantaka and justice R K Agarwal and they observed that there is no doubt the women are really cautious and also careful about their hair. They also observed that women can spend a handsome amount of money to keep their hair in good condition. 

According to the order, it stated, “they are also emotionally attached to their hair. The complainant was a model for hair products because of her long hair. She has also done modeling for VLCC and Pantene. But due to haircutting against the instructions by the opposite party no. 2 (ITC hotels Ltd) she lost her expected assignments and suffered a huge loss which completely changed her lifestyle and shattered her dreams to be a top model.” The complainant was also planning to continue with the modeling assignments which were related to hair products and she also got offered a movie role.

On April 12, 2018, the model, Aashna Roy visited the salon which is located at hotel ITC Maurya for a nice haircut and also had an upcoming interview that was scheduled for her. So she wanted a perfect haircut for her upcoming interview. The woman then asked for her regular hairstylist. But unfortunately, she was not available at that moment and therefore the salon provided another hairstylist on assurance from the staff. But then the woman was shocked that despite the woman giving specific instructions that she wanted long flicks/layers covering her face in front and at back, and 4-inch straight hair trim from the bottom the hairstylist chopped her entire hair and left only 4 inches from the top which touched her shoulder. 

After knowing the fault The salon staff also offered her free hair treatment. But then the woman stated that it was dubious and it resulted in damage to her hair. As for the record made by the commission, “her scalp was burnt with a severe burning sensation due to hair treatment and there was itching and flaking on the scalp. The chemical used in hair treatment has caused permanent damage to her scalp.”

The commission also recorded that she was working as a senior management professional and was earning a nice income. The order further read that, “she underwent severe mental breakdown and trauma due to negligence of the opposite party no. 2 in cutting hair and could not concentrate on her job and finally lost her Job. This apart, the opposite party no. 2 is also guilty of medical negligence in hair treatment. Her scalp was Burnt and still, there is allergy and itching due to the fault of the staff of the opposite party no. 2.”  Because of the irresponsibility and the fault of the part of ITC Hotel Ltd, she has been left with little or almost no hair. 

The commission noted that she also stopped looking at herself in the mirror and carrying on her social activities. As she is a communication professional she had to be involved in many meetings and interactive sessions but as her self-confidence was lost due to having little hair she was not able to do so. Due to this, she suffered a loss of income and a mental breakdown after the shoddy haircut and the worst hair treatment. So she left her job and she went through pain and trauma for the last two years after this incident happened. 

The order then read that the compensation of 2 crores should be paid to the complainant within 8 weeks.
